Introduction to the NDIS Legislation Changes

On October 3, 2024, new NDIS legislation changes took effect, focusing on improving participant experience and ensuring alignment with the Scheme’s original purpose. These updates, part of the National Disability Insurance Scheme Amendment (Getting the NDIS Back on Track No.1) Bill passed on August 22, 2024, represent a significant step in supporting participants more effectively.

In this post, we’ll explore the key updates and discuss their impact on Short Term Accommodation (STA), or respite care. If you’re a participant, a family member, or someone involved in support planning, we’re here to clarify what these changes mean for you and how Visionary Respite and Care is prepared to meet these needs moving forward.

While we cover essential points here, we strongly recommend that participants and their support networks review the complete changes on the official NDIS website to ensure they’re fully informed.

Key NDIS Legislation Changes as of October 3, 2024

The new legislation clarifies how NDIS funds can be used and aims to streamline access to critical supports. Here’s a summary of the main changes:

1. New Definition of NDIS Supports

One of the most impactful updates is a revised definition of what constitutes an NDIS-approved support. This change aims to help participants and providers understand precisely how funds can be allocated:

  • Eligible Supports: Participants’ funds can now only be used for items explicitly listed as approved NDIS supports.

  • Clear Exclusions: A new list identifies items no longer eligible for NDIS funding, making it easier to understand what the Scheme will and won’t cover.

  • Flexible Substitutions: In specific situations, participants can replace a non-NDIS support with a comparable item if it falls within the updated guidelines.

These guidelines are intended to ensure that funding is used in the best way possible for each participant, offering both transparency and consistency.

2. Budget Transparency in Plans

Another valuable change is how budgets are displayed in participants’ NDIS plans. New and updated plans will now show:

  • Total Budget Amounts: A full overview of the budget in one clear number.

  • Detailed Funding Components: A breakdown of each funding component.

  • Funding Periods: Transparency about how long funds are expected to last.

Additionally, if a participant finds their budget challenging to manage, the National Disability Insurance Agency (NDIA) can modify the plan management type to provide additional budgeting support. This update makes NDIS plans easier to understand, empowering participants to use their funds more effectively.

How Do These Changes to NDIS Legislation Impact Short-Term Accommodation (STA)?

One of the main questions for many is how these updates affect Short Term Accommodation (STA). With various interpretations of STA rules circulating online, we went directly to the source—the NDIS legislation—to ensure we provide you with the most accurate, up-to-date information.

STA Remains an Approved Support

Good news: STA continues to be a fully supported service under the new NDIS rules, as highlighted in the Supports that are NDIS Supports document. STA, often referred to as respite, is included under “Assistance with daily life tasks in a group or shared living arrangement.” This means STA remains a vital part of NDIS, supporting participants and their informal caregivers.

What is STA?

Short Term Accommodation (STA) offers participants a break from their regular living situation. STA isn’t just a “change of scenery”; it provides both participants and their caregivers—like family members—a much-needed rest. STA typically involves at least one overnight stay, allowing participants to engage in new experiences, foster friendships, and enjoy structured activities.

What Does STA Funding Cover?

STA funding covers essential services, including personal care, accommodation, meals, and agreed-upon activities. The NDIS generally provides up to 28 days of STA each year, which participants can use flexibly:

  • Primary Caregiver Support: STA is designed to help informal supports, such as family members, sustain their caring roles.

  • Flexible Stays: Participants may choose to enjoy a continuous stay of up to 14 days or spread their STA days over weekends or specific breaks.

  • Plan-Managed Freedom: Those who manage their plans independently can choose unregistered providers for STA.

  • Flexible Core Funding: STA doesn’t have to be specifically built into your plan—Core funding can be allocated to STA when needed.

Staying Informed About NDIS Legislation Changes

With these legislative updates, the NDIS is committed to guiding participants through the transition. As more rules come into effect, additional clarifications will be shared with participants, ensuring everyone can confidently navigate their plans.
